Después
de más de dos años de discusiones entre la Comisión, el Concejo y el Parlamento
Europeos, y también entre los estados, las discrepancias entre esos órganos
oficiales de la UE acerca de la que sería la nueva norma orgánica europea
continúan y las discrepancias siguen siendo más o menos las mismas.
En este blog se comentaron en varias oportunidades esas
marchas y contramarchas (*) (**). Las discrepancias sobre los textos propuestos son
respecto de la severidad de la evaluación del cumplimiento de la norma orgánica
entre las partes y la necesidad de un régimen justo para las importaciones de
productos orgánicos a Europa.
Para la Argentina y terceros países, los puntos álgidos son 1) la pretensión de una
regulación extremadamente severa sobre los umbrales de residuos de pesticidas y
de otros agroquímicos (en algún momento se pretendió un nivel cero), y 2) que
la aprobación de productos orgánicos de importación dependa del nivel de
identidad o equivalencia de las normas del país de origen con las de la UE.
Según el texto de la newsletter del IFOAM-EU, si las
negociaciones tuvieran que continuar en Enero, habrá un debate de otros seis
meses. Y si luego de esto los participantes llegaran a un acuerdo se adoptaría
una nueva regulación en Junio del 2017. Luego tomaría otros 12-18 meses para
desarrollar la implementación de la norma. Esto significaría que en el mejor de
los casos no podría esperarse un nuevo paquete normativo para antes del 2018 y
su puesta en vigor ocurriría no antes del 2019.
Es de notar que todo esto está ocurriendo 24 meses
después de que la Comisión amenazara de que, de no llegarse a un acuerdo en
seis meses, la propuesta de la nueva regulación sería retirada.

After more than two
years of arguments among the Commission, the Council and the Parliament of the
EU, as well as among the states, the discrepancies among these official organs
about the new European organic regulation still go on, and they are about the
same as in the beginning.
We have commented
several times in this blog those discrepancies (*) (**) that are mainly on the severity of the
evaluation of the compliance of the norm and the necessity of a fair import
regime of organic products into Europe.
For Argentina and
other third countries the main problems are 1) the severity of the demand about
the thresholds of pesticide and other agrochemical residues (of which at some
time a zero threshold was demanded); and 2) that the acceptance of imports of
organic products depend on the level of identity or equivalence of the organic
standards of the country of origin with those of the EU.
According to the article
in the IFOAM-EU newsletter, should negotiations continue in January, another
six-month debate can be expected. If, after this, the negotiating parties
should come to an agreement, a new regulation would be adopted in June 2017,
and it would take another 12-18 months to develop all the implementing rules.
This means that in the best of the cases a complete package cannot be expected
before 2018 and the entry into force of the new regulation is likely to start earliest
in 2019.
The article points
out that all this is happening 24 months
after the Commission threatened that if an agreement did not happen in six
moths the proposal for the new regulation would be withheld.
