CONDENA POR "DELITO DE PELIGRO"

La Cámara 1ª del Crimen de Córdoba dio a conocer ayer los fundamentos de la sentencia por la cual impuso dos condenas de ejecución condicional y una absolución, en el juicio oral seguido contra tres imputados de contaminar, mediante el uso de agroquímicos, en una zona barrial de la capital provincial. En el fallo, los camaristas destacaron que lo que se juzgó «no es un delito de lesión, sino de peligro, que no exige que afecte a la salud, sino que posiblemente la afecte», al tratarse de residuos que «posean componentes que los tornen peligrosos para la salud de organismos vivos, lo que ha quedado fehacientemente demostrado». El tribunal, integrado por Lorenzo Rodríguez, Susana Cordi Moreno y Mario Capdevilla, por unanimidad, condenó a Jorge Parra, propietario de un campo cultivado con soja, próximo al barrio Ituzaingó Anexo, a tres años de prisión de ejecución condicional.

AGROCHEMICALS: JUDGED “CRIMINAL OFFENSE OF DANGER”. RATIONAL FOR THE SENTENCE” (Ámbito Financiero, Campo, Sept. 6, 2012)

 The First Chamber of Criminal Offense of Cordoba (Argentina) published yesterday the rationale for the two conditional sentences and one acquittal in the oral trial followed to three accused of contaminating with agrochemnicals a populated area of the provicial capital. In the sentence, the judges pointed out that what it was judged was not a “damage offense, but the danger or possibility of causing damage, not considering if it actually did affect the health of the population”, taking into account that “the sprayed product contained components dangerous for live organisms, something that has been clearly demonstrated”. The court unanimously sentenced Jorge Parra, owner of the field cultivated with soybeans, close to barrio Ituzaingó Anexo, to three years of conditional prison.
